RoomiesSydney ("we," "us," or "our") operates a technology platform accessible at https://roomiesydney.netlify.app that connects Spanish-speaking individuals looking for compatible flatmates and rental properties in Sydney, Australia.

By accessing or using our Services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our platform.

2. Eligibility

You must be at least 18 years old to use RoomiesSydney. By registering, you confirm that you meet this age requirement. We reserve the right to terminate accounts of users found to be under 18 without prior notice.

The Services are intended for individuals who are legally permitted to reside and work in Australia, or who are planning to do so.

3. User Accounts

To access most features of RoomiesSydney, you must create an account. You agree to:

• Provide accurate, current and complete information during registration
• Keep your profile information up to date and truthful at all times
• Keep your password secure and confidential
• Be solely responsible for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

You may delete your account at any time from your profile settings. Upon deletion, all your personal data, matches, messages and groups will be permanently removed from our systems.

4. Prohibited Activities

By using RoomiesSydney you agree NOT to:

• Create fake, misleading or fraudulent profiles
• Send spam or unsolicited messages to other users
• Post offensive, abusive, discriminatory, threatening or inappropriate content
• Impersonate another person or entity
• Harass, intimidate or threaten other users
• Use the platform for any illegal purpose
• Attempt to gain unauthorized access to other accounts or our systems
• Collect or harvest personal data of other users without their consent
• Use automated tools, bots or scripts to interact with the platform
• Post content that violates intellectual property rights of any third party

We reserve the right to suspend or permanently delete any account that violates these rules, without prior notice and at our sole discretion.

5. Fees and Payment

Registration and use of the RoomiesSydney platform is free of charge for all users.

RoomiesSydney may charge a fixed commission fee to tenants who successfully arrange a rental through connections made on our platform. This fee:

• Will be clearly communicated to the relevant parties before any transaction is completed
• Is processed off-platform via direct arrangement
• Is non-refundable once a rental agreement has been signed by all parties

We reserve the right to update our fee structure with reasonable prior notice to users.

RoomiesSydney acts solely as a technology platform. To the fullest extent permitted by law, we are not responsible for:

• The accuracy, completeness or truthfulness of information provided by users or property owners
• Any rental agreements, disputes or financial arrangements between users and property owners
• Any loss, damage or harm resulting from interactions between users
• The availability, condition or suitability of any property listed on the platform
• Any interruption, suspension or termination of the Services

We strongly recommend that all users independently verify any property and person before entering into any rental agreement. Our total liability to you for any claim shall not exceed the amount paid by you to us, if any.

Your use of RoomiesSydney is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

We store user data on servers located in Singapore via Supabase. By using our Services, you consent to the transfer and processing of your data in Singapore and Australia.

9. Term and Termination

These Terms remain in full force and effect while you use the Services. We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or applicable law.

You may terminate your account at any time by using the account deletion feature in your profile settings.

10. Dispute Resolution

Informal Negotiations

Before initiating any formal proceedings, the parties agree to attempt to resolve any dispute through informal negotiations for at least 30 days from the date written notice of the dispute is provided.

Binding Arbitration

If informal negotiations fail, any dispute shall be resolved by binding arbitration in Sydney, Australia, conducted in English before a single arbitrator in accordance with applicable arbitration rules.

Exceptions

The above dispute resolution process does not apply to claims involving intellectual property rights, privacy violations or requests for injunctive relief.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. You irrevocably consent to the exclusive jurisdiction of the courts of Australia for any disputes arising from these Terms.
